With all of the flu frenzy sweeping the globe, can an employer force an employee to get vaccinated?

My gut feeling is no... but I could argue both sides of this issue.

I would say that you cannot... but this is s such a gray area because of OSHA guidelines as well about a safe work environment for other employees.

No, the employer has no right to force the employee it is all you if you want to get vaccinated or not. Getting vaccinated is a good idea but as I was saying no one has the right to force you.

I believe an employer cannot force you to be vaccinated, but iff he or she is truly worried, the will probably come up witha to BS reason to fire you.

When I was in Navy boot camp, we were forced to get all childhood vaccinations, whether we needed them or not. We were also required to get the flu shot every year. But then, the military is a totally different animal from normal employees!

I get the flu shot every year, and rarely get sick. If an employer is offering to pay for it, why not get it? Or, if you have a flex account, use that. It's well worth it!

If you are the employer, offer to pay for the vaccine, or a percentage (say 50 or 75) of the vaccine, rather than force your employees to get it. I'll bet most will take you up on the offer!

There is no law that allows them to force the employees to get vaccinated. So legally, they can't do this.

In Massachusets they passed a law saying you will be quarantined if you don't get the vacanation. That is the only place that I know of that can force you to do so. If you work in a place susceptible to it you should really consider it. Examples of this are health care workers and people who work with children.

They can not force you to undergo any type of medical procedure for the job unless it is the nature of the job - like a clinical trial that you sign up for.

Employers can advise you to get vaccinated, but can not force you. People can always cite religious reasons for anything. As a former school employee, we had to sign a waiver stating we were not getting a certain vaccine. Then if there were an outbreak of say mumps, and I had not been vaccinated, I'd be asked not to come to work at that time and could use my sick days.

I think you might have to demonstrate a reason why you should be exempt from the requirement, such as disability or religious/moral conviction. Otherwise I think most employment agreements stipulate that an employer can require you to do anyting reasonable, and could argue that it's reasonable to get a vaccine that protects your health and that of your co-workers.

I'm sure you can not be forced to undergo any medical procedure. In right-to-work states you can be fired without cause so take that into consideration. If you're in the medical profession like an EMT or nurse, it's possible that it could become a job requirement but that's a pretty gray area.
